Not As Described: If The Buyer Demonstrates That One Of The Following Are True, The Seller Must Provide A Refund:

  • The item received is a different than what displayed and described on the shop and not limited to color, model, version, or size, ingredients
  • The item has a different design or material.
  • The item was advertised as authentic but is not authentic.

  • The quantity of items you ordered was not what was received.

CRAFTY Shall Have Right To Design Any Program Related To Tier And Displaying Seller As Per CRAFTY Policy Not Limited To : First Display, Prioritize The Seller Shop, Promote Seller Shop On CRAFTY Social Media Or Website Or Any Other Media Channels. Sellers Can Design Their Own Discount Program Using The Discount Feature For The Sellers. Seller Shall Not Offer Any Discount That Does Not Compliance With UAE Economic Of Department Rule For Discount.

16. FOOD PRODUCTS

CRAFTY Does Not Sell Any Food Item Listed On The Website Directly, We Collect Payments Only As An Agent Of The Seller And As Such We Do Not Guarantee Any Item Listed On The Website Or Any Transaction Between A Buyer And Seller. The CRAFTY Payments Policy (Or The “Policy”) Sets Out Your Rights And Responsibilities When You Use CRAFTY Payments On Crafty's Services (We’ll Refer To CRAFTY.Com, CRAFTY's Mobile Apps, And Other Services As Our “Services”), CRAFTY Payments Allows Sellers To (A) Accept Payment By Authorized Credit And Debit Card Transactions And Cash. Payments Are Transferred Twice, Mid And End Of The Month For Completed Orders As Per Your Choice, On Your Bank Account, Which Is A Free Transfer Or Via Exchange (20 Dirhams Fee).

Holds And Delays CRAFTY Have Those Funds Deposited Into A Seller’s Designated Bank Account Within 30 Days From Receiving Cash Amount. If We Believe That A Seller's Actions May Result In Buyer Disputes, Chargebacks, Or Other Claims, Then We May, In Our Sole Discretion, Put A Hold, Deposit Delay, Reserve On The Seller’s Payment Account Balance A Hold May Be Put On Funds Associated With A Particular Transaction If There Is A Dispute Or Investigation Related To The Order, For The Shorter Of: (A) 180 Days After The Estimated Delivery Date, Or (B) Completion Of Any Investigation Regarding The Seller’s Actions. Deposit Delays Are Defined As The Number Of Days Between A Sale And The Day The Net Amount From The Sale Becomes Available For Deposit, Provided The Payment Has Been Completed. A Deposit Delay May Be Between 0 And 180 Days. A Deposit Delay Is Applied Across All Transactions For A Seller And The Number Of Days Is Reflected In Each Seller’s Payment Account. If CRAFTY Places A Hold, Deposit Delay, Or Reserve On A Seller’s Account, We’ll Do Our Best To Communicate With The Affected Seller As Soon As We Can. We Always Work Hard To Avoid And Minimize Any Delays. However, Please Note That CRAFTY Is Not Obligated To Refund Any Fees Or Reimburse Any Expenses Due To Holds Or Delayed Deposits It Is The Seller’s Sole Responsibility To Update Their Bank Account Information To Receive The Funds. If A Seller Fails To Update The Information To Claim The Funds Within A Certain Period Of Time, CRAFTY Will Escheat The Funds To The Relevant Government Authority In Order To Comply With Escheatment Laws. Sellers Shall Followup And Suite The Third Party For Any Financial Lost Due To Third Party Once Confirmed By CRAFTY.

B. Fee Amount. CRAFTY Will Charge Payment Processing Fees Of 3%: CRAFTY Payments Is Only Available To Sellers Who Used Legitimate And Authorized Credit Card Account. Sellers May Use CRAFTY Credit Card Payments For The Sale Of Items Listed On Crafty's Services, And Agree To Ship Sold Items Once A Payment Transaction Is Complete And Reflected In Their Payment Account. CRAFTY Reserves The Right To Terminate A Seller’s Access To CRAFTY Payments If The Seller Uses CRAFTY Payments In Any Other Manner. Buyer May Use CRAFTY Cash Payments For The Purchase Of Items Listed On Crafty's Services, And Seller Shall Agree To Transfer The Amount Once Ship Sold Items Is Complete And Accepted By The Buyer. CRAFTY Has Engaged Third-Party Service Providers To Perform Many Of The Services Related To Payment Processing, Including Payment Gateway, Cash Pick Up And Delivery To CRAFTY By Shipment Couriers. By Using A Third-Party Service, You May Also Be Subject To An Agreement With The Third Party Such As Payment Gateway T&C. If CRAFTY Receives Notice That Your Shop's Content Or Activity Violates A Third Party's Service Agreement, We May At Our Sole Discretion Take Action Against Your Account To Comply With Their Policies. Such Actions May Include Canceling A Transaction, Disabling Listings From Your Shop, Suspending Your Selling Privileges, Or Removing Certain Payment Methods. The Provider And Processing Time For Your Payment Will Vary Based On Many Condition. CRAFTY May Share Your Personal Or Transactional Information With Those Third-Party Service Providers When It's Necessary To Process Payments.

19. MISCELLANEOUS

These Terms Constitute The Entire Agreement Of The Parties With Respect To The Subject Matter Hereof And Supersede All Previous Written Or Oral Agreements Between The Parties With Respect To Such Subject Matter. No Waiver By CRAFTY Of Any Breach Or Default Hereunder Shall Be Deemed To Be A Waiver Of Any Preceding Or Subsequent Breach Or Default. If Any Provision Of These Terms Shall Be Unlawful, Void, Or For Any Reason Unenforceable, Then That Provision Shall Be Deemed Severable From The Terms And Shall Not Affect The Validity And Enforceability Of Any Other Provisions Of The Terms. The Headings And Captions In These Terms Are Intended For Convenience Only And Shall In No Way Affect The Interpretation Of The Terms.

CRAFTY Shall Not Be Liable For Any Non-Performance Or Delay In Performance Caused By Any Act Beyond Its Reasonable Control, Including Without Limitation Acts Or Omissions Of Third Parties, Unavailability Of Supplies, Equipment Failure, War, Strikes, Lock-Outs, Fire, Flood, Or Any Other Act Of God, Any Law, Regulation, Ordinance, Or Other Act Or Order Of Any Court, Government, Or Governmental Agency, Or Delays, Unavailability, Errors, Or Other Failures Of The Internet Or Other Data Networks.

20. GOVERNING LAW

This Agreement Shall Be Governed By And Construed In Accordance With The Laws Of Dubai, UAE, Without Regard To Conflicts Of Law Provisions. Additionally, Any Claims Brought Against CRAFTY Shall Be Governed By And Construed In Accordance With The Laws Dubai, UAE. Sole And Exclusive Jurisdiction For Any Action Or Proceeding Arising Out Of, Or Related To, This Agreement, Use Of The CRAFTY Services, Or Any Orders Placed, Or Products Or Services Purchased Through Any Of Them, Shall Be In The State Or Federal Courts Located In Dubai, UAE.

21. INTELLECTUAL PROPERTY

The Site And All Of Its Materials, Including But Not Limited To Its Software Or HTML Code, Script, Text, Mobile Application Code, Text, Artwork, Design, Logo, Photographs, Images, Video, Audio, Feature (Collectively "Materials") Are Protected By Copyright Laws And Other UAE Law And Treaties And Aare Property Of Crafty Or Its Licensors. You May Not Copy, Reproduce, Publish, Transmit, Distribute, Perform, Display, Post, Modify, Create Derivative Work From, Sell, License Or Otherwise Exploit The Site Or Any Of Its Materials Without Our Prior Written Permission. You Many Not Access Or Use The Site For Any Competitive Or Commercial Purpose, Nor May You Perfmit Any Copying Oof Our Materials. Any Unauthorized Copying, Alternation, Distribution, Transmission, Performance, Display Or Other Use Of These Materials Is Prohibited. CRAFTY Reserves All Rights Not Expressly Granted As Applicable.

  • harasses, abuses, stalks, threatens, defames, or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights);
  • is unlawful, fraudulent, or deceptive;
  • provides sensitive personal information unless specifically requested by CRAFTY,
  • includes spam or any unsolicited advertising; (e) uses technology or other means to access CRAFTY or Content that is not authorized by crafty;
  • uses or launches any automated system, including without limitation, "robots," "spiders," or "offline readers," to access CRAFTY or Content;
  • attempts to introduce viruses or any other computer code, files, or programs that interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment; (h) attempts to gain unauthorized access to crafty’ computer network or user accounts;
  • encourages conduct that would constitute a criminal offense or that gives rise to civil liability;
  • violates these Terms;
  • attempts to damage, disable, overburden, or impair crafty’ servers or networks;
  • impersonates any person or entity or otherwise misrepresents your identity or affiliation with another person or entity;
  • fails to comply with applicable third party terms (collectively "Acceptable Use"). CRAFTY reserves the right, in its sole discretion, to terminate any User License, terminate any User’s participation in the Sites, remove Content, or assert legal action with respect to Content or use of the Sites, that CRAFTY reasonably believes is or might be in violation of these Terms, or CRAFTY policies including the CRAFTY Card Terms and Conditions. crafty’ failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.
